FUTURE GENERATION DONATION APPLICATION GUIDELINES
1) Future Shop Future Generation Tech Lab Grant program (the “Program”) will review and select public secondary schools across Canada to participate in the Program, which includes but is not limited to the provision of a cash donation of up to $50,000 by Future Shop to each of the selected schools based on the budget provided by each school in their application.
2) No purchase is necessary to enter the Program. The Program is voluntary and the provision of up to $50,000 to the selected schools is a donation. Any and all equipment purchased with the donation becomes the property of the selected school.
3) The Application form must be fully complete, and submitted by one teacher, or by several staff with support of their students and the school board or district. The application must be approved by the principal of the school. The applicable school district for the selected schools will be required to execute the attached agreement. Future Shop reserves the right to amend this agreement.
4) Only one application per secondary school can be submitted.
5) Applications will be considered in the order in which they are received.
6) ) Program participation will be determined by a panel of 6 program judges. The program judges will decide which schools will be selected to participate in the program based on the quality and creativity of the applications provided by the schools and other considerations, including but not limited to: how the donation will be used to provide an enhanced learning experience for students; how many students will be impacted by the donation; a focus on grade 9-12 students (secondary 3 to 5 in Quebec); and the school’s need for resources. Decisions of the Program selection committee in respect of any aspect of the Program are final and binding on all entrants.
7) The applicant and its applicable school board may be contacted if additional information regarding the application if required.
8) Applicants will ensure that the proper permission and release documentation are received for the content of their application videos or images, including but not limited to intellectual property licenses and photographic image releases. Applicants agree to indemnify and hold Future Shop, its parent, affiliates, subsidiaries, officers and agents harmless from any and all claims relating to a breach of third party intellectual property.
9) ) Applications will be accepted starting September 20, 2011 and must be received by 6:00 p.m. EST on November 17, 2011 in order to be considered for the Program.
10) The selected applicants for the Program will be contacted by telephone or in-person on or about January 31, 2012.The selected participants for the Program will also be announced publically in February 2012. By making an application to the Program, the entrants agree to the public announcement of their selection for the Program.
11) The selected schools must be available to participate in the Program and complete the Future Shop Tech Lab no later than August 30, 2012. Participation includes but is not limited to providing access to the Tech Lab, and a list of contact persons at the applicable schools who are responsible for the program. The selected participants will provide Future Shop with a properly executed Program agreement no later than 30 days after the selection of the participant in the Program.
12) If a selected participant does not provide an executed Future Generations Tech Lab Program agreement within the timeline set out below, that participant will be disqualified and another entrant will be selected by the Program selection committee.
13) By entering the Program, the entrants agree to Future Shop’s disclosure of their participation in the Program, including but not limited to including the school district’s name in a list of Program entrants.
14) Future Shop and its parents, subsidiaries and affiliates will not, under any circumstances, be responsible for, or liable to any Program entrant or any other person for:
A. any erroneous, lost, damaged, late, incomplete, misdirected, deleted, defective, or altered Program entries, regardless of the cause;
B. any failure for any reason whatsoever of the selected entrant to receive Program participation acceptance notification;
C. any changes in email addresses or email address assignments or telephone numbers after Program entry forms are submitted;
D. any computer, online, telephone, or technical malfunctions or errors that may occur, regardless of the cause; or
E. any damage or loss, including any loss of use, loss of production, loss of profits (anticipated or otherwise), loss of markets, economic loss, special, indirect or consequential loss or damage or punitive damages, whether in contract, tort or under any other theory of law or equity, arising from, connected with, or relating to the Program or the submission of entries to the Program or participation in the Program, or the use of the www.futureshop.ca web site (including the downloading of any materials from that web site) and regardless of the cause or any negligence by Future Shop or anyone for whom Future Shop is responsible, and notwithstanding that Future Shop may have been advised of the possibility of such loss or damage being incurred.
15) If for any reason the Program is not capable of being conducted as intended by Future Shop, including due to computer viruses, bugs, tampering, unauthorized intervention, fraud, technical failures, or any other cause that corrupts or interferes with the administration, security, fairness, integrity or proper conduct of the Program, Future Shop may, at its sole discretion, disqualify any entrant responsible for such misconduct and cancel, terminate, modify, or suspend the Program.
16) CAUTION: ANY ATTEMPT TO DELIBERATELY DAMAGE ANY WEB SITE OR INTERFERE WITH THE LEGITIMATE OPERATION OF THE PROGRAM MAY BE A VIOLATION OF CRIMINAL AND CIVIL LAWS, AND FUTURE SHOP RESERVES THE RIGHT TO SEEK DAMAGES AND/OR OTHER RELIEF FROM ALL RESPONSIBLE PERSONS TO THE FULLEST EXTENT PERMITTED BY LAW.
17) Return of any Program participation acceptance notification as undeliverable may result in disqualification, and an alternate participant may be selected.
18) Participation in the Program constitutes acceptance and agreement to these Program rules.
19) The Program is subject to all applicable federal, provincial and local laws and is void where prohibited by law. If any provision of these rules is found by any court of competent jurisdiction to be unenforceable, all other provisions will remain in full force and effect.
